Facts and circumstances surrounding each settlement payment must be considered to determine the purpose for which the money was received because not all amounts received from a settlement are exempt from taxes. Exclusion from taxable income with respect to lawsuits, settlements and awards, must be considered to determine the purpose for which the money was received because not all amounts received from a settlement are exempt from taxes. And there are special rules related to the deductibility of attorney's fees incurred related to a settlement.

Learning objectives:
1) Understand which lawsuit settlements are exempt from tax.
2) Determine which settlements are eligible to deduct attorney fees.
3) Review related tax reporting documents such as 1099's the taxpayer may receive
4) Develop processes for categorizing settlement payments which settle before a court judgment. Consider the audit exposure related to taxes on legal settlements.
