From the President

SEASONS 

Winter is always followed by spring. Spring is followed by summer. Next, fall puts an end to summer too quickly for most of us. Our lives, like seasons, cycle in the same way.  It seems that most things do. During particularly challenging times, perhaps related to money health, family, job, or over-stretched time schedule, it helps to keep in mind that spring always follows winter.  Winter never lasts forever and spring always comes. Some winters are longer than others, some are shorter, but they end. I can remember being comforted during rough times by my father in law Alan who would tell my wife Cheryl and me to remember that the saying says “and it came to pass”, not “and it came to stay”.

Tax season is the same way. It will end. Spring will come. Can we avoid our “winters”?  I don’t think so. During our “winters” we struggle more than in our “summers”, but we learn and grow during struggle. Isn’t it true that there is always some “winter” going on in our lives? Don’t we all have struggles and challenges going on all the time? Yes we do! It’s what we do as human beings. We struggle through the hard things so we can grow and enjoy the “summers” in our lives. Perhaps, while we are suffering through our own personal winter, we can find joy in someone else’s summer.

Can we relate this to tax season? Sure! As tax professionals, tax season can be winter or summer. It is winter because of the extra deadlines and increased work load, but that means more money to enjoy during the summer that will surely follow. Also, you are helping your clients through their winter. Do you think clients like tax season? Or, is it a winter for them because they are freaking out over the extra work they have to do to get records, so many new records, together for you. Maybe they are freaking out over the possibility of a tax bill due to all the changes that they are hearing about on every news channel.  Well, it’s your chance to turn their winter into spring by their knowing that you are in their corner and that you have your tax toolbox ready to put to work for them.

Keep in mind, “and it came to pass” not “and it came to stay”. This tax season will succumb to spring. It always does. Enjoy the journey and help as many people as you can along the way.

Thank you! Thank you! Thanks to all of you who wrote letters, made calls, spoke to your friends and clients, and even attended legislative hearings in opposition to AB 1140.

A special thanks to Karen DeVaney from CSTC Modesto who attended the Assembly hearing on behalf of CSTC. Way to go and thank you, Karen!

CSTC issued an opinion letter when AB 1140 first came before the California Assembly. We recently reissued our opinion letter, thanks to Rod Couts, Linda Beckett, Ruth Godfrey, Jenn Baker, and others who helped review the drafts so we could get it filed prior to the assembly hearing on January 23, 2020.

It was awesome to see how many of you called your assembly representatives to express your opposition to the Bill. It was wonderful to see other organizations joining the fight to stand with CSTC.

National Society of Accountants and CSEA got word to their members, our fellow tax professionals, in time for many of them to make calls.

The fight is not over. PLEASE watch your emails as CSTC provides updates. PLEASE respond or take action requested when you are asked to do so by CSTC.

CSTC Member Benefit – VeriFyle Pro

Welcome to Tax Season 2019!  I hope everyone has seen an ‘uneventful’ beginning to 2020 and that your tax season is going well.

After finishing my first Partnership return, I was disappointed that my software still doesn’t provide for eSignature of the eFile forms for business returns.  eSignatures have been fabulous in the Individuals module – it streamlines the process of collecting signatures for eFiling.  I thought I was going to have to print, mail, and await a return mailing to get my signed eFile forms for this Partnership return – but then something wonderful happened!

I’ve been using Verifyle for two years now; Verifyle is a secure portal for transferring documents between my firm and my clients – and currently IT’S FREE FOR ALL CSTC MEMBERS! CSTC negotiated a contract with Verifyle to provide their services to CSTC members in good standing at NO COST (FREE!) to the member.

When I uploaded the K1S to send digital copies to the Partnership members, I saw a new feature – well, new to me!. I’m now able to upload ANY document and request that document be signed and dated by the client.  WOW! This was such a fabulous discovery! I’ll be utilizing this signature feature for many things…

  3. My FBAR & CryptoCurrency questionnaire
  4. My Due Diligence questionnaires

 News from the IRS 

2020 Tax Filing Season

The IRS is now accepting and processing federal tax returns for tax year 2019. The deadline to file a 2019 tax return and pay any tax owed is Wednesday, April 15, 2020.

The IRS strongly encourages people to file their tax returns electronically and choose direct deposit for faster refunds. Filing electronically reduces tax return errors as the tax software does the calculations, flags common errors and prompts taxpayers for missing information.

Free Tax Return Preparation/EITC

The Volunteer Income Tax Assistance (VITA) program offers free tax help to people who generally make $56,000 or less, persons with disabilities and limited English-speaking taxpayers who need assistance in preparing their own tax returns. In addition to VITA, the Tax Counseling for the Elderly (TCE) program offers free tax help for all taxpayers, particularly those who are 60 years of age and older, specializing in questions about pensions and retirement-related issues unique to seniors.

Many taxpayers that qualify for free tax return preparation may also qualify for the Earned Income Tax Credit.  Taxpayers earning $55,952 or less can see if they qualify using the EITC Assistant tool at IRS.gov/eitc available in English and Spanish, The tool helps users determine if they are eligible and if they have a qualifying child or children, and it estimates the amount of the EITC they may get.

IRS Free File

Most taxpayers can get an early start on their federal tax returns as IRS Free File – featuring brand-name online tax providers − opens today at IRS.gov/freefile for the 2020 tax filing season.

Taxpayers whose adjusted gross income was $69,000 or less in 2019 – covering most people – can do their taxes now, and the Free File provider will submit the return once the IRS officially opens the 2020 tax filing season on January 27 and starts processing tax returns.

Taxpayer First Act

On July 1, 2019, The Taxpayer First Act of 2019 was signed into law, which aims to broadly redesign the Internal Revenue Service. Generally, the legislation aims to expand and strengthen taxpayer rights and to reform the IRS into a more taxpayer friendly agency by requiring it to develop a comprehensive customer service strategy, modernize its technology and enhance its cyber security.

Tax Reform

The IRS is working on implementing the Tax Cuts and Jobs Act. This new law includes major tax legislation that will affect both individuals and businesses. Check the Tax Reform page for the latest updates.

Tax Withholding

The Tax Cuts and Jobs Act changed the way tax is calculated. The IRS encourages taxpayers to perform a quick “paycheck checkup” by using the Withholding Estimator to check if they have the right amount of withholding for their personal situation.

Consumer Alerts on Tax Scams

‪Note that the IRS will never:

  • Call to demand immediate payment using a specific payment method such as a prepaid debit card, gift card or wire transfer. Generally, the IRS will first mail you a bill if you owe any taxes.
  • Threaten to immediately bring in local police or other law-enforcement groups to have you arrested for not paying.
  • Demand that you pay taxes without giving you the opportunity to question or appeal the amount they say you owe.
  • Ask for credit or debit card numbers over the phone.

Is it Really the IRS Calling?

The IRS wants you to understand how and when we contact taxpayers and help you determine whether a contact you may have received is truly from an IRS employee.

The IRS initiates most contacts through regular mail delivered by the United States Postal Service.

However, there are special circumstances in which the IRS will call or come to a home or business, such as when a taxpayer has an overdue tax bill, to secure a delinquent tax return or a delinquent employment tax payment, or to tour a business as part of an audit or during criminal investigations.

Private Debt Collection

The IRS began a new private collection program of certain overdue federal tax debts selecting four contractors to implement it. The groups are: CBE Group of Cedar Falls, Iowa; Conserve of Fairport, N.Y.; Performant of Livermore, Calif.; and Pioneer of Horseheads, N.Y. The taxpayer’s account will only be assigned to one of these agencies, never to all four. No other private group is authorized to represent the IRS.

The IRS will always notify a taxpayer before transferring their account to a private collection agency (PCA). The IRS will send a letter to the taxpayer and their tax representative informing them that their account is being assigned to a PCA and giving the name and contact information for the PCA. This mailing will include a copy of Publication 4518, What You Can Expect When the IRS Assigns Your Account to a Private Collection Agency (PDF).

Foreign Account Tax Compliance Act (FATCA)

FATCA refers to the Foreign Account Tax Compliance Act that requires reporting on specified foreign accounts by U.S. taxpayers and foreign financial institutions. In general, federal law requires U.S. citizens to report worldwide income, including income from foreign trusts and foreign bank and securities accounts.
