President's Column
How Long? ... How Long?

A fellow practitioner asked me recently for the guidelines for how long to keep tax returns. I told him it’s really our clients’ responsibility to keep their own tax returns. Our only actual requirement from the IRS is to keep a list of the names and social security numbers for the tax returns we prepared. 

But, of course, we’re professionals, and we keep the tax returns not just to meet some minimum requirement, but to use for next year’s preparation, to keep a history, and to help our clients.

So I gave him the basic rules for tax returns:

  • 3 years for federal income tax returns
  • 4 years for CA income tax returns
  • 6 years for federal income tax returns if more than 25% of the income is omitted
  • No limit for fraud
  • 4 years for payroll tax returns
  • 3 years for sales tax return 

And all of these dates are counted from the filing date, so that extends into the following year. I tell my clients to keep the actual tax return forever, and the backup information for a minimum of 5 years.

But while I answered the question, I felt like I should have added more. There’s an overriding principle for keeping records which is: Keep them as long as they may be relevant.

For example, if you buy an asset, such as a house or stock, you need to keep your purchase records to prove basis when you sell the asset. Similarly, capital improvements on a home or rental will affect the gain or loss when the property is sold or otherwise disposed of, so records of these improvements need to be kept until after the property is sold.

Another area where records need to be kept for longer than usual is net operating losses (NOLs). A recent court case, Betty Amos v. Commissioner, illustrates this perfectly.

The taxpayer in this case is, ironically, a CPA with a very successful practice of high-level tax work. She also ran a total of 15 Fuddrucker’s restaurants. The restaurants were very profitable until 1999, when one restaurant closed, causing an NOL carryforward of $1.5 million. The restaurants continued to do poorly and close, causing more losses. By the time she prepared her 2015 return, her NOL carryforwards were about $4.3 million.

The IRS audited her 2013 and 2014 tax returns and disallowed the NOL carryforwards because the taxpayer did not have the underlying records substantiating the losses in 1999 and 2000. She also did not have the necessary records to show the history of the NOL carryovers in the subsequent years. 

She took it to tax court and advanced various arguments. But essentially, the judge said the NOLs had never been audited or their legitimacy tested, and since she could not produce the needed substantiation to prove them, the IRS was correct in disallowing them. 

So the lesson for us and for our clients is keep those records!

National Tax Security Awareness Week, Day 4: Choosing a unique Identity Protection PIN adds extra safety for taxpayers

IR-2022-210, December 1, 2022 — As part of a broader effort to increase security, the Internal Revenue Service and the Security Summit partners today reminded taxpayers they could get extra protection starting in January by joining the agency’s Identity Protection Personal Identification Number (IP PIN) program.

Security Summit offers tools, tips to tax pros during National Tax Security Awareness Week; highlights importance of security plans

IR-2022-209, November 30, 2022 — With tax season quickly approaching, the Internal Revenue Service and the Security Summit partners today urged tax professionals to remain focused on security issues and to review resources available to them, including sample security plans and checklists.

Treasury and IRS announce guidance on wage and apprenticeship requirements for enhanced credits/deductions

IR-2022-208, November 29, 2022 — The Treasury Department and Internal Revenue Service today announced guidance providing taxpayers information on how to satisfy the prevailing wage and apprenticeship requirements for enhanced tax benefits under the Inflation Reduction Act. The guidance will be published in the Federal Register tomorrow.

IRS hosts first centralized National Virtual Settlement Event helping more taxpayers settle Tax Court cases

IR-2022-207, November 29, 2022 — The Internal Revenue Service announced today that the IRS Office of Chief Counsel partnered with the American Bar Association Tax Section to hold its first centralized National Virtual Settlement Event. This four-day event was inspired by the monthlong virtual event held in March 2021 during the height of the COVID-19 pandemic.

Interest rates increase for the first quarter of 2023

IR-2022-206, November 29, 2022 — The Internal Revenue Service today announced that interest rates will increase for the calendar quarter beginning January 1, 2023.

National Tax Security Awareness Week: Giving Tuesday highlights that scammers may use phony charities to trick taxpayers

IR-2022-205, November 29, 2022 — On Giving Tuesday, the Internal Revenue Service and its Security Summit partners warned taxpayers to be on alert for scammers using fake charities to commit fraud not just during the holiday season but year-round.

IRS, Security Summit partners begin National Tax Security Awareness Week; urge people to watch out for holiday scams and protect personal information as tax season nears

IR-2022-204, November 28, 2022 — On Cyber Monday, the Internal Revenue Service and the Security Summit partners kicked-off the 7th National Tax Security Awareness Week with information for taxpayers and tax professionals on how to avoid scams and protect sensitive personal information.

IRS Advisory Council issues 2022 Annual Report

IR-2022-200, November 15, 2022 — The Internal Revenue Service Advisory Council (IRSAC) today issued its annual report for 2022, including recommendations to the IRS on new and continuing issues in tax administration.

IRS reminds taxpayers IRS Free File remains open until Nov. 17

IR-2022-199, November 15, 2022 — The Internal Revenue Service today reminded those who still need to file their 2021 tax returns that IRS Free File remains open until November 17 and can help those who qualify claim the Child Tax Credit, Recovery Rebate Credit or Earned Income Tax Credit.

IRS’ five-year Strategic Plan now available in Spanish

IR-2022-198, November 10, 2022 — The Internal Revenue Service announced today that, for the first-time ever, the agency’s Strategic Plan for Fiscal Years 2022-2026 is now available in Spanish. This announcement aligns with the IRS’s continued effort to expand tax resources in more languages to provide taxpayers with the service they deserve.

IRS announces job openings to hire over 700 new employees across the country to help taxpayers in person

IR-2022-197, November 9, 2022 — In addition to the more than 4,000 people recently hired to fill critical customer service representative positions, the Internal Revenue Service is now seeking over 700 new employees to help taxpayers at Taxpayer Assistance Centers across the country.

Treasury and IRS expand program for approving certain retirement plans

IR-2022-196, November 7, 2022 — The Treasury Department and Internal Revenue Service today announced the expansion of one of their programs for approving retirement plans.

IRS Independent Office of Appeals’ priorities for 2023 focus on taxpayer service

IR-2022-195, November 4, 2022 — Today, the IRS Independent Office of Appeals released its focus guide for fiscal year 2023. Appeals is taking important steps to expand communications with external stakeholders and to improve taxpayer access to Appeals.

IRS-CI releases FY2022 annual report highlighting more than 2,550 investigations, 90% conviction rate; enforcement actions focused on tax fraud, money laundering, cybercrimes

IR-2022-194, November 3, 2022 — In fiscal year 2022, IRS Criminal Investigation initiated more than 2,550 criminal investigations, identified over $31 billion from tax and financial crimes, and obtained a 90.6% conviction rate on cases accepted for prosecution.

IRS seeks comments on upcoming energy guidance

IR-2022-193, November 3, 2022 — The Internal Revenue Service today issued three notices asking for comments on different aspects of extensions and enhancements of energy tax benefits in the Inflation Reduction Act.
