President's Column
They're taking over...!

Chatbots are all the rage these days, especially since the introduction of Bard, Google’s entry into the chatbot arena. It seems every day there’s a story in the news about the chatbots, either appraising their abilities or lamenting the jobs that are going to be lost to them.

That the chatbots will affect many jobs and occupations is, I think, without doubt. The question is rather which jobs will be affected and how. My daughter-in-law is a college professor in Material Science Engineering, and she reports that her colleagues in the engineering and science departments are not worried about any significant effect in their departments. However, those in the English and Literature departments are definitely concerned.

That makes sense since the chatbots are primarily language-based and so perform best at language-based tasks, such as writing an article or a report. However, as one writer pointed out to me, chatbots will never produce good writing. Because they synthesize large amounts of ordinary writing, their results will be necessarily be ordinary. They can write an adequate, or even good, commencement speech, for example, but they can never write an extraordinary or outstanding speech. The good authors and speech writers can always outperform a chatbot.

Still, chatbots will impact many occupations, and parts of even more occupations. Which, of course, leads to the thought – what about my job? Will I be affected? How will the tax and accounting profession be impacted? If ChatGPT could pass the Bar Exam, could it pass the CPA Exam?

So I was intrigued when I saw that  the company TaxBuzz had tested ChatGPT on taxes. When asked, “What status should I use when filing my taxes?”, ChatGPT gave definitions of the various filing options. As for advice on which to choose, it said, “You can consult a tax professional to help determine the best option for you”! Maybe chatbots will drive more business to us!

To test ChatGPT further, TaxBuzz used actual questions posted on its tax practitioner technical support forum. ChatGPT provided incorrect answers 100% of the time! Though it was usually on the right track, it missed nuances of the tax code.

For example, one question was about a newly married couple where the wife had been a Florida resident the previous year. ChatGPT gave advice about filing a Florida state tax return, even though Florida doesn’t have state income tax!

Another question was about a mobile home that parents gave to their daughter. The parents had owned it for a long time. The daughter sold it a few months later. ChatGPT gave the wrong answer about tax benefits concerning the holding period and selling the home at a loss.

Why can’t the chatbots get it right? Because tax professionals have education and training, as well as access to verified libraries of information to use when analyzing the tax code. ChatGPT doesn’t have that level of brainpower or education. Chatbots can quote facts, but they can’t analyze or apply the relevant tax principles.

My conclusion: we tax professionals aren’t currently being threatened by the advent of chatbots, even ever-improving chatbots. They may even be useful to improve search engines and research tools, but our role as tax advisors has not been replaced.

But maybe I could use ChatGPT to write my next column….

If you’re anything like me, you’ll be spending the next few weeks dreaming about everything that you’ll finally be able to do now that tax season has ended: laundry, cooking, sleeping, seeing your family, and, of course, planning for the Summer Symposium.

Obviously, the Symposium is a great place to get your education for the year (you can get all of your CTEC hours in one go!) and we have a fantastic lineup this year, if I do say so myself.  But Symposium isn’t just about education.

News from the IRS 

IR-2023-65, March 31, 2023 — The Internal Revenue Service today cautioned taxpayers to resist questionable tax practitioners and independent promoters selling schemes aimed at wealthy taxpayers.
IR-2023-64, March 31, 2023 — The IRS today issued proposed regulations related to certain requirements that must be met for critical minerals and battery components for the new clean vehicle credit.
IR-2023-63, March 30, 2023 — As part of the annual Dirty Dozen tax scams series, the Internal Revenue Service today renewed a warning about so-called Offer in Compromise “mills” that often mislead taxpayers into believing they can settle a tax debt for pennies on the dollar. 
IR-2023-62, March 29, 2023 —The IRS today warned tax professionals and businesses that they remain a top target for identity thieves and face threats from common scams on this year’s Dirty Dozen list.
IR-2023-61, March 28, 2023 — The IRS today continued the Dirty Dozen series with a warning on day seven about trusting tax advice on social media that can lure otherwise honest taxpayers and tax professionals into compromising tax situations.
IR-2023-60, March 28, 2023 — Mississippi storm victims now have until July 31, 2023, to file various federal individual and business tax returns and make tax payments, the Internal Revenue Service announced today.
IR-2023-59, March 27, 2023 — The IRS today continued the Dirty Dozen series by cautioning taxpayers to avoid unscrupulous tax return preparers and provided important tips to find the right tax professional.
IR-2023-58, March 24, 2023 — New York winter storm and snowstorm victims now have until May 15, 2023, to file various federal individual and business tax returns and make tax payments, the Internal Revenue Service announced today.
IR-2023-57, March 24, 2023 — On day five of the annual Dirty Dozen campaign, the Internal Revenue Service today urged everyone to be on alert for scammers using fake charities to dupe taxpayers, especially following major disasters.
IR-2023-56, March 23, 2023 — The Internal Revenue Service reaches out in multiple ways to educate taxpayers while ensuring it fairly enforces the nation’s tax laws. There are important factors to keep in mind about when the IRS may initiate direct contact with a taxpayer.
IR-2023-55, March 23, 2023 — As part of this year’s Dirty Dozen tax scams, the Internal Revenue Service today warned taxpayers to watch out for promoters pushing improper fuel tax credit claims that taxpayers aren’t qualified to receive.
IR-2023-54, March 22, 2023 — The IRS today warned taxpayers to watch out for scammers who try to sell or offer help setting up an Online Account on IRS.gov that puts their tax and financial information at risk of identity theft.
IR-2023-53, March 22, 2023 — The Internal Revenue Service today revised frequently asked questions (FAQs) for Form 1099-K, Payment Card and Third Party Network Transactions, in Fact Sheet FS-2023-06.
IR-2023-52, March 21, 2023 — The Internal Revenue Service today issued proposed regulations that provide guidance regarding the implementation of The Advanced Manufacturing Investment Credit, established by the Creating Helpful Incentives to Produce Semiconductors Act of 2022, commonly known as the CHIPS Act.
IR-2023-51, March 21, 2023 — With the filing deadline quickly approaching, the Internal Revenue Service today urged everyone to remain vigilant against email and text scams aimed at tricking taxpayers about refunds or tax issues.
IR-2023-50, March 21, 2023 — The Treasury Department and the Internal Revenue Service today announced that they are soliciting feedback for upcoming guidance regarding the tax treatment of a nonfungible token (NFT) as a collectible under the tax law.
IR-2023-49, March 20, 2023 — In a further warning to people and businesses, the Internal Revenue Service added widely circulating promoter claims involving Employee Retention Credits as a new entry in the annual Dirty Dozen list of tax scams.
IR-2023-48, March 20, 2023 — With only a few days remaining before the April 18 filing deadline, the Internal Revenue Service today reminded taxpayers how to avoid common errors on their federal tax returns and help get possible refunds sooner.
IR-2023-47, March 17, 2023 — The Internal Revenue Service today posted frequently asked questions that address whether certain costs related to nutrition, wellness and general health are medical expenses that may be paid or reimbursed under a health savings account (HSA), health flexible spending arrangement (FSA), Archer medical savings account (Archer MSA) or health reimbursement arrangement (HRA).
IR-2023-46, March 15, 2023 — The Internal Revenue Service reminds taxpayers that the Where's My Refund? tool on IRS.gov is the most convenient way to check the status of 2022, 2021 and 2020 tax refunds. IRS2Go, the mobile app, offers another way for users to check their refund status.
IR-2023-45, March 13, 2023 — Danny Werfel began work today as the 50th commissioner of the Internal Revenue Service.
IR-2023-44, March 9, 2023 ― With the tax deadline approaching, the IRS reminded taxpayers they can avoid late filing and interest penalties by submitting their tax return and any payments due by April 18. For struggling taxpayers who can’t pay by the deadline, the IRS offers several different options to help.
IR-2023-43, March 9, 2023 — The Internal Revenue Service today reminded retirees who turned 72 during 2022 that, in most cases, Sunday, April 1, 2023, is the last day to begin receiving payments from Individual Retirement Arrangements (IRAs), 401(k)s and similar workplace retirement plans.
IR-2023-42, March 8, 2023 — The Internal Revenue Service today announced it will accept supplemental applications for Low Income Taxpayer Clinic (LITC) matching grants from all qualified organizations. The application period will run from March 7, 2023, to April 18, 2023.
IR-2023-41, March 8, 2023 — As part of ongoing transformation efforts, the Internal Revenue Service announced today the successful expansion of digital scanning.
IR-2023-40, March 7, 2023 — The Internal Revenue Service today issued a renewed warning urging people to carefully review the Employee Retention Credit (ERC) guidelines before trying to claim the credit as promoters continue pushing ineligible people to file.
IR-2023-39, March 6, 2023 — The IRS will again open on Saturday at many Taxpayer Assistance Centers across the country on March 11 from 9 a.m. to 4 p.m. as part of its efforts to improve service this tax season. Additional Saturday openings are planned for April 8 and May 13.
IR-2023-38, March 3, 2023 — The Internal Revenue Service issued a consumer alert today to warn taxpayers of new scams that urge people to use wage information on a tax return to claim false credits in hopes of getting a big refund.
IR-2023-37, March 2, 2023 — Registration for this summer’s 2023 IRS Nationwide Tax Forums is now open. The forums return to an in-person format in five cities across the nation for the first time since 2019.
IR-2023-36, March 2, 2023 — The Internal Revenue Service today announced the selection of eight new members to serve on the Taxpayer Advocacy Panel for 2023.
IR-2023-35, March 1, 2023 — The Internal Revenue Service reminds taxpayers of their reporting and potential tax obligations on income from the gig economy and service industry, transactions from digital assets, and foreign sources or holding certain foreign assets.
