President's Column
And We're Off!

As I write this column, tax season is just getting underway. E-filing opened this week, and our clients, having received most of their tax documents, are beginning to call. Having finished the last of our update seminars, we’re at the starting gate, ready to apply that knowledge and start preparing those returns.

But first, let’s take a minute to review our recent tax seasons…

  • 2018, coming on the heels of TCJA, the largest tax code revision in three decades, was tough. We had to scramble to learn the new law, and to explain the many changes to our clients!
  • 2019 again started with a major tax law passed in December – the SECURE Act – but it was the COVID lockdown in March that upended everything! Not only were we all dealing with COVID and the resulting logistical challenges, but we also had a retroactive tax law passed in March and a deadline extended to July!
  • It seemed no season could be worse than tax season 2019, and that is probably true. But 2020, with partial lockdowns still in effect, brought us PPP loans and forgiveness, employer tax credits, rebate recovery credits and a deadline extended to May!
  • So last year, 2021 looked to be an improvement. And in many ways, it was. But we still had the COVID credits and PPP loans to deal with, and the reconciliations of the Recovery Rebate Credit and the Advanced Child Tax Credit. And to make it worse, the IRS was hopelessly backlogged by mail and unavailable by phone, meaning we couldn’t resolve any issues that arose.

So what does 2022 look like? The good news is that almost all of the special COVID provisions have expired and that means no reconciling credits! But as the numbers return to the pre-COVID amounts, we’re the ones who have to explain to our clients why their refunds are so much lower this year!

The IRS is more accessible now, so we’ve been able to unravel some of those old outstanding issues. Hopefully we’ll be able to resolve new issues as they arise.

We do have an extended season again this year – until May 15th for most of California – due to the recent flooding. And there are some new laws – the Inflation Reduction Act and the Secure 2.0 Act – but the magnitude of these laws is minor compared to the last few years.

And so, it begins.

Get set . . . supplies replenished . . . computer programs downloaded . . . clients contacted . . .Go!

And we’re off!

FTB to Delay CA Tax Basis Capital Reporting

The FTB has announced that it is delaying the requirement to report partner capital on the tax basis method as calculated under California law for another year. Thus, for 2022 returns, a partnership may report its partners’ capital accounts on Schedule K-1 using the tax basis method as determined under federal law rather than the CA tax basis.

The requirement to use CA tax basis was to go in effect for the 2022 taxable year, but the FTB “has become aware that certain persons required to file Schedule K-1 (565) and Schedule K-1 (568) may be unable to timely comply with the requirement to report partner capital on the tax basis method as calculated under California law for 2022.”

They have therefore delayed requiring CA tax basis for another year. The requirement to use CA tax basis will go into effect for tax year 2023.

National Society of Accountants (NSA)

CSTC is the state affiliate of the National Society of Accountants (NSA). NSA is a national organization that helps independent tax and accounting professionals increase their knowledge, grow their clientele, and elevate their value to provide the best client services and to expand their businesses.

NSA advocates for its members by working with the Internal Revenue Service and Congress in legislative, regulatory, and legal matters. And it works with the state affiliates to fight state laws that could inhibit our right to practice. In 2012, NSA helped the California state affiliate fight a proposal by the California Board of Accountancy that would have required non-CPAs to advertise for CPAs.

Benefits of membership in NSA include discounts with NSA partners for insurance, for research and support, and for business and marketing, such as Constant Contact and UPS. NSA also offers education opportunities, many at no cost, practice management toolkits, and a Tax Help Desk that will research and answer tax questions from members for free.

NSA is not in competition with CSTC. Rather we are working together to help tax and accounting professionals. As a national organization, NSA has more resources and a greater impact with their advocacy and that benefits all of us. NSA is like an extension of CSTC. As CSTC we can meet together in local chapters and focus on California issues; partnering with NSA gives us input and representation on national issues. Becoming a member of NSA is good for you, the individual, and good for CSTC.

News from the IRS 

IR-2023-16, January 27, 2023 — The Internal Revenue Service and partners nationwide today kicked off their Earned Income Tax Credit Awareness Day outreach campaign to help millions of Americans who earned $59,187 or less last year take advantage of the Earned Income Tax Credit (EITC).
IR-2023-15, January 26, 2023 — The Internal Revenue Service today urged employers to be aware of the January deadline to file Forms W-2 and other wage statements. Filing these documents timely prevents late-filing penalties for employers, helps employees file their income tax returns and prevents tax fraud.
IR-2023-14, January 25, 2023 — The Internal Revenue Service announced today that businesses can now file Form 1099 series information returns using a new online portal, available free from the IRS.
IR-2023-13, January 24, 2023 —The Internal Revenue Service today reminded taxpayers to choose a tax return preparer with care. Even though most tax return preparers provide honest, quality service, some may cause harm through fraud, identity theft and other scams.
IR-2023-12, January 24, 2023 — The Internal Revenue Service today reminded taxpayers that they must again answer a digital asset question and report all digital asset-related income when they file their 2022 federal income tax return, as they did for fiscal year 2021. The term “digital assets” has replaced “virtual currencies,” a term used in previous years.
IR-2023-11, January 23, 2023 — The Internal Revenue Service kicked off the 2023 tax filing season with a focus on improving service and a reminder to taxpayers to file electronically with direct deposit to speed refunds and avoid delays.
IR-2023-10, January 19, 2023 — The Internal Revenue Service reminds taxpayers who earn wages to use the Tax Withholding Estimator now to adjust their 2023 withholding.
IR-2023-09, January 19, 2023 — Storm victims in parts of Georgia and Alabama now have until May 15, 2023, to file various federal individual and business tax returns and make tax payments, the Internal Revenue Service announced today.
IR-2023-08, January 18, 2023 — The Internal Revenue Service today reminded employers and other businesses to file Tax Year 2022 Form W-2 and other wage statements by January 31, 2023.
IR-2023-07, January 18, 2023 — The Internal Revenue Service today announced the appointment of nine new members to the Internal Revenue Service Advisory Council.
IR-2023-06, January 17, 2023 — The Internal Revenue Service’s Free File Guided Tax Preparation service is live and ready for taxpayers to use. Free File went live January 13, 2023, 10 days prior to the 2023 filing season start date. The IRS starts accepting individual tax returns on January 23.
IR-2023-05, January 12, 2023 — The Internal Revenue Service today announced Monday, January 23, 2023, as the beginning of the nation's 2023 tax season when the agency will begin accepting and processing 2022 tax year returns.
IR-2023-04, January 11, 2023 — National Taxpayer Advocate Erin M. Collins today released her 2022 Annual Report to Congress, saying taxpayers and tax professionals “experienced more misery in 2022” due to paper processing delays and poor customer service. But the report also says the Internal Revenue Service made considerable progress in reducing the volume of unprocessed tax returns and correspondence and is poised to start the 2023 filing season in a stronger position.
IR-2023-03, January 10, 2023 — California storm victims now have until May 15, 2023, to file various federal individual and business tax returns and make tax payments, the Internal Revenue Service announced today.
IR-2023-02, January 6, 2023 — The Internal Revenue Service recently completed the final corrections of tax year 2020 accounts for taxpayers who overpaid their taxes on unemployment compensation they received in 2020.
IR-2023-01, January 4, 2023 — Many taxpayers make quarterly estimated tax payments during the year to stay current on their taxes, but many who should overlook this step. The Internal Revenue Service today urged those who paid too little tax in 2022 to make a fourth quarter payment on or before January 17 to avoid an unexpected potential tax bill or penalty when they file in 2023.
