Who Knew?

I came across an interesting statistic the other day – the IRS has a 90.6% conviction rate! That means if you’re charged with a financial crime, you’re almost certain to lose!

But this isn’t your common office audit. These are the audits that get referred to Criminal Investigation (CI) for fraud and similar violations. In fiscal year 2022, tax fraud cases handled by CI totaled $5.7 billion, in addition to $26.9 billion in other financial crimes.

The IRS Criminal Investigation publishes a report of its accomplishments every year (Publication 3583). CI is the sixth largest federal law enforcement agency, and the only one that spends 100% of its time on financial investigations. The core of their enforcement efforts is general tax fraud investigation – violations like keeping two sets of books, deliberately choosing not to file a tax return, claiming false deductions or credits, and hiding or transferring assets. They also investigate abusive tax schemes and employment tax fraud.

Their non-tax investigations include money laundering, public corruption, corporate fraud, and providing criminal enforcement for the Financial Crimes Enforcement Network (FinCEN), which mainly involves foreign accounts and transactions. Their newest area of focus is cybercrimes, including tracing and monitoring cryptocurrency and monitoring the dark web.

The 2022 CI report is 46 pages covering all the different areas CI is involved in. it also includes case examples highlighting their successes – from preparers caught filing fraudulent tax returns to the conviction of a Russian cryptocurrency money launderer to helping to take down the largest and longest-running marketplace on the darknet. It’s a bit like reading excerpts from a detective novel or a spy thriller.

And yet, as I considered it more, I realized that I’ve had two brushes with CI. One was an audit where the taxpayer had met with the auditor and then asked me to represent him. When I called the auditor, she told me she was considering referring the case to CI. I immediately stopped my work and recommended he get an attorney.

The second case involved CI of the Franchise Tax Board. I got a call from them, asking to set up an appointment to meet with me. They instructed me not to tell my client about their visit. When they came to my office to look at the tax return, they asked me if I had talked to my client. I said no. They responded that was good; otherwise I could be looking at obstruction of justice charges! They were really serious. My client was eventually convicted of embezzling funds from the county and went to jail.

So if you need a break from preparing tax returns, Publication 3538 has some pretty interesting tidbits. And you can always quote some of their success rates to help keep those recalcitrant clients in line!

News from the IRS 

IR-2023-34, Feb. 28, 2023 — The Internal Revenue Service today reminded businesses with income from farming or fishing that have not already made their estimated tax payments to file and pay their entire tax due on or before Wednesday, March 1, 2023.
IR-2023-33, Feb. 24, 2023 — Disaster-area taxpayers in most of California and parts of Alabama and Georgia now have until Oct. 16, 2023, to file various federal individual and business tax returns and make tax payments, the Internal Revenue Service announced today. Previously, the deadline had been postponed to May 15 for these areas.
IR-2023-32, Feb. 22, 2023 — With the 2023 tax filing season in full swing, the IRS reminds taxpayers to gather their necessary information and visit IRS.gov for updated resources and tools to help with their 2022 tax return.
IR-2023-31, Feb. 21, 2023 — The Department of the Treasury and the IRS today issued final regulations amending the rules for filing returns and other documents electronically (e-file). These regulations will require certain filers to e-file beginning in 2024.
IR-2023-30, Feb. 17, 2023 — The Treasury Department and the Internal Revenue Service today issued Notice 2023-20, which provides interim guidance for insurance companies and certain other taxpayers for the new corporate alternative minimum tax (CAMT) until the issuance of proposed regulations.
IR-2023-29, Feb. 16, 2023 — The Internal Revenue Service announced today that taxpayers who receive certain notices requiring them to send information to the IRS now have the option of submitting their documentation online through IRS.gov.
IR-2023-28, Feb. 16, 2023 — With the nation entering a peak period for filing taxes, the Internal Revenue Service urges taxpayers to use online tools to get answers quickly and avoid phone delays during a traditional peak period for IRS phone lines around Presidents Day.
IR-2023-27, Feb. 13, 2023 — The Department of the Treasury and the Internal Revenue Service today provided guidance following the enactment of the Inflation Reduction Act to establish a program to allocate credits for qualified investments in eligible qualifying advanced energy projects.
IR-2023-26, Feb. 13, 2023 — The Department of the Treasury and the Internal Revenue Service today provided guidance to establish a program to provide solar and wind power to certain low-income areas under the Inflation Reduction Act.
IR-2023-25, Feb. 13, 2023 — The Internal Revenue Service today announced changes to the Bridge phase of the Compliance Assurance Process (CAP) program. CAP is a cooperative pre-filing program for large corporate taxpayers.
IR-2023-24, Feb. 13, 2023 — The Internal Revenue Service today announced that interest rates will remain the same for the calendar quarter beginning April 1, 2023.
IR-2023-23, Feb. 10, 2023 — The IRS provided details today clarifying the federal tax status involving special payments made by 21 states in 2022.
IR-2023-22, Feb. 9, 2023 — In the latest improvement for taxpayers, the Internal Revenue Service announced today that people electronically filing their Form 1040-X, Amended U.S Individual Income Tax Return, will for the first time be able to select direct deposit for any resulting refund.
IR-2023-21 Feb. 8, 2023 — The Internal Revenue Service’s Office of Chief Counsel today announced plans to hire additional attorneys to assist the agency in enhancing the taxpayer experience and addressing high-end, complex noncompliance.
IR-2023-20, Feb. 6, 2023 — As part of a continuing effort to improve service this tax season, the Internal Revenue Service today announced special Saturday hours for the next four months at Taxpayer Assistance Centers (TACs) across the country.
IR-2023-19, Feb. 6, 2023 — The Treasury Department and Internal Revenue Service today issued Notice 2023-13, which contains a proposed revenue procedure that would establish the Service Industry Tip Compliance Agreement (SITCA) program, a voluntary tip reporting program between the IRS and employers in various service industries. The IRS is issuing this guidance in proposed form to provide an opportunity for public comment. 
IR-2023-18, Feb. 3, 2023 — The Internal Revenue Service today issued Notice 2023-16 that modifies the definitions of certain vehicle classifications for the new, previously owned and qualified commercial clean vehicle credits.
